Please read these terms carefully before using Treep 'n' Out

1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Treep 'n' Out ("Company," "we," "us," or "our") governing your access to and use of the Treep 'n' Out mobile application (the "App"), website, and all related services (collectively, the "Services").

By downloading, installing, accessing, or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, do not use the Services.

2. Eligibility

To use Treep 'n' Out, you must:

  • Be at least 13 years of age (or the minimum age required in your jurisdiction).
  • If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you must have parental or guardian consent to use the Services.
  • Have the legal capacity to enter into a binding agreement.
  • Not be barred from using the Services under applicable law.

By using the Services, you represent and warrant that you meet all eligibility requirements. We reserve the right to terminate accounts that do not meet these requirements.

3. Account Registration & Security

To access certain features of the Services, you must create an account. When registering, you agree to:

  • Provide accurate, current, and complete information.
  • Maintain and promptly update your account information.
  • Keep your login credentials confidential and not share them with any third party.
  • Notify us immediately at treepnout@gmail.com if you suspect unauthorized access to your account.
  • Accept responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate your account if any information provided is inaccurate, outdated, or incomplete.

4. User-Generated Content

Treep 'n' Out allows you to post, upload, share, and otherwise make available content including but not limited to photos, videos, text, reviews, travel stories, and comments ("User Content"). By submitting User Content, you:

  • Grant us a license:You grant Treep 'n' Out a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, modify, distribute, display, and perform your User Content in connection with operating and promoting the Services.
  • Retain ownership: You retain all ownership rights in your User Content. This license does not limit your right to use your content elsewhere.
  • Represent and warrant: That you own or have the necessary rights, licenses, and permissions to your User Content and that it does not violate the rights of any third party.

We reserve the right (but have no obligation) to review, monitor, remove, or disable access to any User Content at our sole discretion, including content we determine violates these Terms.

5. Prohibited Conduct

You agree not to:

  • Post content that is unlawful, defamatory, obscene, pornographic, harassing, threatening, hateful, or discriminatory.
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity.
  • Upload viruses, malware, or any other malicious code.
  • Engage in spamming, phishing, or any form of unsolicited advertising or promotion.
  • Use the Services to stalk, bully, intimidate, or harass other users.
  • Collect or harvest user data without consent.
  • Attempt to gain unauthorized access to the Services, other user accounts, or computer systems.
  • Use automated means (bots, scrapers, crawlers) to access or interact with the Services without our prior written consent.
  • Interfere with or disrupt the integrity or performance of the Services.
  • Promote or facilitate illegal activities, including but not limited to fraud, money laundering, or drug trafficking.
  • Post misleading or false travel information that could endanger other users.

Violation of these rules may result in immediate suspension or termination of your account and, where applicable, reporting to law enforcement authorities.

6. Community Guidelines

Treep 'n' Out is a community-driven platform. We expect all users to:

  • Treat fellow community members with respect and courtesy.
  • Share authentic, honest travel experiences and recommendations.
  • Respect local cultures, customs, and environments when sharing content.
  • Report inappropriate content or behavior through our in-app reporting tools.
  • Engage constructively in community discussions and respect differing opinions.

7. Intellectual Property Rights

The Services, including all content, features, and functionality (including but not limited to text, graphics, logos, icons, images, audio clips, software, and the compilation thereof) are owned by Treep 'n' Out or its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

The Treep 'n' Out name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Treep 'n' Out. You may not use such marks without our prior written permission.

8. Third-Party Services & Links

The Services may contain links to third-party websites, services, or content that are not owned or controlled by Treep 'n' Out. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that Treep 'n' Out shall not be responsible or liable for any damage or loss caused by your use of any such third-party services.

9. In-App Purchases & Subscriptions

Treep 'n' Out may offer in-app purchases or subscription plans. By making a purchase, you agree to the following:

  • Payment:All purchases are processed through Apple App Store or Google Play Store. Payment terms are governed by the respective platform's terms of service.
  • Auto-Renewal:Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel subscriptions through your device's app store settings.
  • Refunds: Refund requests are handled by the respective app store (Apple or Google) in accordance with their refund policies. We do not directly process refunds for app store purchases.
  • Price Changes: We reserve the right to change subscription prices. You will be notified in advance of any price changes, and the new price will take effect at the start of the next billing cycle.

10. Privacy & Data Protection

Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy. By using the Services, you consent to our data practices as described in the Privacy Policy.

Key points include:

  • We collect only the data necessary to provide and improve the Services.
  • We do not sell your personal information to third parties.
  • You may request deletion of your account and associated data at any time by contacting us at treepnout@gmail.com.
  • We comply with applicable data protection regulations including GDPR, CCPA, and other relevant privacy laws.

11. Location Services

Certain features of the Services may require access to your device's location data. You may enable or disable location services through your device settings. Please note that disabling location services may limit the functionality of certain features, such as discovering nearby events, communities, or travel experiences.

12. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Services will be uninterrupted, secure, or error-free.
  • Any information provided through the Services is accurate, reliable, or complete.
  • Travel information, recommendations, or advice shared by users is accurate or safe. You are solely responsible for verifying any travel information before acting on it.
  • Defects in the Services will be corrected in a timely manner.

Treep 'n' Out is not a travel agency and does not organize, manage, or operate any travel activities, tours, or events shared on the platform. We are not responsible for the safety, quality, or legality of any experiences shared or organized by users.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TREEP 'N' OUT, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM:

  • Your access to, use of, or inability to use the Services.
  • Any conduct or content of any third party on the Services.
  • Any User Content posted or made available through the Services.
  • Unauthorized access, use, or alteration of your transmissions or content.
  • Any personal injury or property damage resulting from travel activities discovered through the Services.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNTS YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS ($100), WHICHEVER IS GREATER.

14. Indemnification

You agree to indemnify, defend, and hold harmless Treep 'n' Out and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

  • Your use of the Services.
  • Your violation of these Terms.
  • Your violation of any rights of any third party.
  • Your User Content.

15. Termination

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.

Upon termination:

  • Your right to use the Services will immediately cease.
  • We may (but are not obligated to) delete your account and User Content.
  • Sections of these Terms that by their nature should survive termination shall survive (including Intellectual Property, Disclaimers, Limitation of Liability, and Indemnification).

You may terminate your account at any time by contacting us at treepnout@gmail.com or through the account deletion feature in the App.

16. Dispute Resolution

Informal Resolution: Before filing a formal claim, you agree to try to resolve any dispute informally by contacting us at treepnout@gmail.com. We will attempt to resolve the dispute within 30 days.

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the Republic of Ghana, without regard to conflict of law principles.

Arbitration: Any disputes arising out of or relating to these Terms or the Services that cannot be resolved informally shall be settled through binding arbitration, rather than in court, except that you may assert claims in small claims court if qualifying.

Class Action Waiver: You agree that any proceedings to resolve disputes will be conducted only on an individual basis and not in a class, consolidated, or representative action.

17. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to the new terms taking effect, through the App, email, or other reasonable means.

Your continued use of the Services after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Services.

18. App Store Compliance

If you download or access the App through the Apple App Store or Google Play Store, you also agree to the following:

  • Apple App Store:These Terms are between you and Treep 'n' Out only, not Apple Inc. Apple has no obligation to furnish any maintenance and support services with respect to the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you. Apple is not responsible for addressing any claims relating to the App. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms.
  • Google Play Store:These Terms are between you and Treep 'n' Out only, not Google LLC. Google has no obligation or liability with respect to the App or these Terms. You acknowledge that Google is not responsible for providing support services for the App.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

20. Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices or policies published by us on the Services, constitute the entire agreement between you and Treep 'n' Out regarding the use of the Services.
